
CONDITIONS FOR RETURN
Pursuant to the provisions of the Law no 4077 on Protecting the Rights of Consumers as further amended by the law no. 4822, Divin is liable to abide by the conditions for “product return” and “return of defective products”. Pursuant to the law on distant online sales over www.divin.com.tr or by phone through www.divin.com.tr, Divin customers may exercise their right of withdrawal from the contract without producing any reason within 7 days. Such right of withdrawal exercised goes into effect provided the request for withdrawal be notified to www.divin.com.tr within 7 days.
The Law no 4077 on Protecting the Rights of Consumers as further amended by the law no 4822 does not introduce an unconditional condition for return for purchases from stores. In this respect, Divin reserves its right of rejecting any returned product in cases of returns based on purchases from Divin stores, and/or when it deems necessary.
The customers of www.divin.com.tr may call 0212 513 02 48 or send an email to info@divin.com.tr to notify Divin of their request of withdrawal. Any procedure of return without such a notification procedure will not be accepted.
The customer may not exercise his/her right of withdrawal for any product produced and customized in line with the particular requests of the customer. Request for return will be null in such cases except for the event where the product is defective.
For a customer to be eligible for returning any product(s) purchased from www.divin.com.tr on the strength of his/her right of withdrawal, the product(s) should be returned at conditions prevailing at the time of the initial delivery to the customer. In other words, the product, product box (the box enclosing the product apart from the order package), product certificate, invoice, freight bill and all other documents accompanying the order should completely be sent to the address to be specified by Divin or www.divin.com.tr for a valid return. Any defect, loss or damage during the process of return is not under the responsibility of Divin or www.divin.com.tr.
Following the approval of the return procedure by Divin, the entirety of the amount collected for the product is returned to the customer via the same payment method (credit card, bank transfer or EFT, whichever used by the customer) after making necessary deductions for any defect, damage or loss. If the product was sold by payment instalments via credit card, the dates of such instalments will be considered at the repayment. Repayment of the order by credit card and other methods is subject to the bank approval and this period differs by banks. Divin may not be held liable for any probable delay.
In addition to the right of withdrawal, the Law no 4077 on Protecting the Rights of Consumers as further amended by the law no 4822 also grants consumers with the right of returning the defective product. Pursuant to the law, in case its authorized specialists confirm the defect on the product within 30 days following the date of the sale, Divin is liable to return the paid amount to the consumer, replace the defective product with one free from any defect, apply a discount to the extent of the defect or repair the defective product free of charge. In case no defect is found on the product, the consumer may not claim any right other than the right of withdrawal from the contract within 7 days.
Accordingly, in case the customers have received a defective product ordered from Divin or www.divin.com.tr, they may apply to Divin by calling 0212 513 02 48 or emailing to info@divin.com.tr.
With effect from the date of delivery to the consumer and subject to the coverage of the warranty period specified, in case the same failure recurs for minimum 3 times or different failures occur for minimum 5 days or total of different failures occurring within the guarantee period reaches 7 in a year; in case these failures consistently prevent the consumer from utilizing the product; in case the maximum period of 30 days is exceeded for the repair; and in case the repair of the product is impossible, the customers will be entitled to claim from Divin a free product replacement, return of the product’s amount or a discount to the extent of the defect.
Customer-based defects such as misuse, accident, ordinary wear-out or deformation are outside this coverage.
Any purchase of a product from Divin’s website, www.divin.com.tr, means the terms and conditions stated above have been agreed and accepted by the customer. |
